1. Before we start looking into the Articles, the author wants to draw the reader’s attention to the fact that in the four pages of documents there is no mention at all of the word “KRIYA,” or “KRIYA YOGA,” instead the words “Hindu Yoga” are mentioned in Article II (e) 6.
According to the general practice or norm to state the purposes in a legal instrument, first the important ones are set out as the “primary purposes” and then the secondary ones. So let us see what were the first and important purposes of the corporation. Article II deals with the purposes of the corporation.
2. Article II (a), (b) and (c), deal with real estate and personal properties. Article II reads as follows:
[See page 1 of the Articles of Incorporation.]
That the purposes for which this corporation [Self Realization Fellowship Church] is formed are as follows:
(a) To acquire by gift or contribution both real and personal property of any kind or nature whatsoever, or any right, title or interest therein.
(b) To buy, sell or otherwise encumber, and to transfer and to exchange real estate or every kind and of any interest therein, and to trade in real property improved and unimproved in the state of California, and elsewhere.
(c) To borrow and lend money and to make and issue promissory notes, bonds, debentures and evidence of indebtedness and to secure the payment or performance of its obligations by mortgage, deed of trust, pledge or otherwise.
From the above-mentioned (a), (b), and (c) it is clear that the primary purpose the founder had in the mind was starting a corporation, commercial in nature, and (d) religion was secondary according to the arrangement of the Articles of Incorporation.
[See page 2 of the Articles of Incorporation.]
This part of Article II clearly states the purposes of the corporation. It covers the whole range of operations of a mortgage company, a real estate developer (promoter), a building construction company, a financial institution to lend money, and to trade real estate properties.
